Memorandum of Agreement

Made and entered into the fourth day of October one thousand eight hundred and seventy eight
Between William Burrill of Carlsmoor in Dallowgill in the Parish of Kirkby Malzeard in the County of York Yeoman and William George Almack of West Tanfield in the said County Grocer and Draper

It is hereby agreed between the said parties hereto that in consideration of the several sums of Four hundred pounds and One hundred pounds of sterling money (making together the sum of Five hundred pounds) to the said William Burrill lent and paid by the said William George Almack (and for which said sums the said William Burrill has signed and delivered to the said William George Almack his said Promissory Notes, as to Four hundred pounds part thereof his Promissory Note dated the fourth day of April one thousand eight hundred and seventy eight, and as to One hundred pounds residue thereof his Promissory Note dated the fourth day of October one thousand eight hundred and seventy eight) the Documents comprised in the Schedule hereunder written relating to the title of a Leasehold Estate situate at Carlsmoor aforesaid and now in the possession of the said William Burrill have been deposited by the said William Burrill with the said William George Almack and shall henceforth be held by the said William George Almack his executors administrators and assigns as security for the payment by the said William Burrill his executors administrators or assigns to the said William George Almack his executors administrators or assigns on the fourth day April next of the sum of Five hundred pounds sterling with interest thereon at the rate of Four pounds per centum per annum

And the said William Burrill doth hereby charge all the hereditaments and premises comprised in the said Documents with the said payment to the said William George Almack his executors administrators or assigns of the said sum of Five hundred pounds and interest thereon after the rate aforesaid And the said William Burrill doth hereby covenant and agree with the said William George Almack that he the said William Burrill his executors or administrators will at any time or times during the continuance of this security upon the request of the said William George Almack his executors administrators or assigns but at the costs of the said William Burrill his executors or administrators execute to the said William George Almack his executors administrators or assigns a mortgage of the said hereditaments and premises in such form and in such power of Sale and other provisions as the said William George Almack his executors administrators or assigns may reasonably require for further securing the payment as aforesaid of the money which shall then be owing upon this security with interest thereon after the rate aforesaid As witness the hands of the said parties the day and year first hereinbefore written

A Memorial was registered at the West Riding Registry of Deeds at
Wakefield the 16th of August 1886 at 10.0 in the forenoon in
